These Terms of Service (“Terms”) govern your use of the Color Instinct website, services, and related offerings. By using our website or purchasing services, you agree to these Terms.

Color Instinct is operated by Chromatic Circus LLC dba Color Instinct.

Services

Color Instinct provides color analysis services, including:

In-person color analysis
Digital color analysis
Custom Services, including weddings, corporate events, group events, and other specialized engagements
Gift cards and related offerings

We reserve the right to modify, discontinue, or update services at any time.

Bookings and Payments

Services may be booked through our website or other approved channels.

Payment is due as specified at the time of booking.

All payment processing is handled through third-party providers. We do not store complete credit card information.

Cancellation, Rescheduling, and Refunds

Cancellations made 72 or more hours before in-person appointments receive a full refund. Cancellations made between 48 and 72 hours before the appointment receive a 50% refund. Appointments cancelled less than 48 hours before the appointment are non-refundable. Appointments may be rescheduled at no charge with more than 48 hours' notice. Rescheduling requests made within 48 hours of the appointment will be treated as a cancellation and are subject to the policy above. No-shows are non-refundable.

Due to the personalized nature of our services, all "Online Color Analysis" purchases are final and non-refundable.

Specific policies communicated during booking are incorporated into these Terms.

Client Responsibilities

Clients agree to provide accurate information reasonably necessary to perform services.

For digital analyses, clients are responsible for providing photographs and other requested materials that reasonably represent their appearance.

Intellectual Property

All reports, palettes, recommendations, graphics, documents, PDFs, educational materials, website content, branding, logos, and other materials provided by Color Instinct remain the property of Chromatic Circus LLC unless otherwise stated.

Materials provided to clients are for personal, non-commercial use only.

Clients may not reproduce, distribute, sell, publish, modify, or create derivative works from our materials without prior written permission.

Gift Cards

Gift cards may be subject to additional terms communicated at the time of purchase.

Gift cards are not redeemable for cash except where required by law.

Disclaimer of Professional Advice

Color analysis services are based on aesthetic principles, professional judgment, and subjective evaluation.

Recommendations are provided for informational and personal style purposes only.

Results may vary between individuals, and we do not guarantee any particular outcome, satisfaction level, personal benefit, professional benefit, or stylistic result.

Limitation of Liability

To the fullest extent permitted by law, Chromatic Circus LLC dba Color Instinct shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our website, services, reports, recommendations, or materials.

Our maximum liability for any claim shall not exceed the amount paid by the client for the specific service giving rise to the claim.

You agree not to:

Use the website for unlawful purposes
Interfere with website security or operation
Attempt unauthorized access to systems or information
Copy or misuse website content

Privacy

Your use of our services is also governed by our Privacy Policy

Termination

We reserve the right to refuse service, cancel bookings, or terminate access to our website if these Terms are violated or if circumstances otherwise warrant.

Governing Law

These Terms shall be governed by and interpreted under the laws of the State of Colorado, without regard to conflict of law principles.
